Terms of Service
Effective 26 August 2026These are the terms on which Superaxe LLC provides the SuperAxe gym-management service. They are written to be read; if anything here is unclear, ask us before you agree to it.
1. Who we are and what this covers
SuperAxe is a gym-management service operated by Superaxe LLC ("SuperAxe", "we", "us"). These Terms govern your use of the SuperAxe web application, its check-in kiosk, public join forms, member invoices, and every related service (together, the "Service").
By creating an account, accepting an invitation to a gym's workspace, or using the Service, you agree to these Terms. If you are accepting on behalf of a gym or company, you confirm you have the authority to bind it, and "you" means that organization.
2. Accounts and workspaces
A gym's data lives in its own workspace. The person who creates a workspace is its owner. Owners may invite staff and set each person's role; each role sees and can do only what the workspace allows it to.
You are responsible for keeping your login credentials private and for everything done under your account. Tell us at once if you believe your account has been used without your permission.
You must provide accurate account information and keep it current. You may not create accounts for anyone other than yourself or the organization you represent.
3. Your data and your members' data
Everything a gym enters into the Service — member records, attendance, bookings, notes, billing history — belongs to the gym. We process it only to provide the Service, as described in our Privacy Policy, and on the gym's instructions.
The gym is responsible for having a lawful basis to collect and store its members' information, for telling members how their information is used, and for honouring members' requests about their own data. We give you the tools to export and delete records so you can meet those obligations.
You keep ownership of your data. You grant us the limited right to host, copy, and process it as needed to run the Service, and to produce anonymised, aggregated statistics that cannot identify any gym or person.
4. Payments and billing through the Service
Where a gym takes payments through the Service, those payments are processed by Stripe under the gym's own Stripe account and Stripe's terms. SuperAxe never holds member funds and never stores full card numbers.
The gym decides what to charge, when, and whether to charge saved cards automatically. The Service carries out those decisions and records them; it does not make them. The gym is responsible for refunds, disputes, and any fees its payment processor charges.
Fees for the Service itself, where they apply, are set out in your plan. Fees are billed in advance, are non-refundable except where the law requires otherwise, and may change with at least 30 days' notice.
5. Acceptable use
You agree not to:
- use the Service to break the law, or to store information you have no right to store;
- send unsolicited messages to people who have not agreed to hear from your gym;
- attempt to gain access to another workspace, another user's account, or the Service's infrastructure;
- interfere with the Service, probe it for weaknesses without our written permission, or reverse-engineer it;
- resell the Service or offer it to third parties as your own.
We may suspend or close accounts that break these rules. Where practical we will warn you first.
6. Availability and support
We work to keep the Service available around the clock but do not promise uninterrupted access. We may take the Service down briefly for maintenance and will try to do so outside a gym's busy hours.
The Service can send reminders, follow-ups, and payment notices on a gym's behalf when the gym turns those automations on. Every automation is off until the gym switches it on, and the gym can switch it off at any time.
7. Ending the agreement
You may stop using the Service and close your workspace at any time. Before you do, export the data you want to keep. After closure we delete the workspace's data within 90 days, except where the law requires us to keep records longer.
We may end this agreement if you materially breach it and do not put the breach right within 14 days of being told, or immediately if the breach cannot be put right.
8. Warranties and liability
The Service is provided "as is". To the fullest extent the law allows, we make no warranties about it, and we are not liable for indirect, incidental, or consequential loss, or for lost revenue, data, or goodwill, arising from your use of the Service.
Our total liability to you for any claim arising from these Terms is limited to the fees you paid us for the Service in the 12 months before the claim arose, or USD 100 if you paid nothing.
Nothing in these Terms limits liability that cannot be limited by law.
9. Changes to these Terms
We may update these Terms. If a change materially reduces your rights we will tell you at least 30 days before it takes effect, by email or inside the Service. Continuing to use the Service after that date means you accept the updated Terms.
